Terms & Conditions

1. General

Sidai Trails Safaris & Retreats (“we,” “our,” “us”) provides safari, retreat, and travel experiences in Kenya and beyond. By booking with us, you (“client,” “guest,” “participant”) agree to these Terms & Conditions in full.

 

2. Booking & Payment

  • Bookings are confirmed only upon receipt of the agreed deposit or full payment.

     

  • Final balances must be paid by the due date indicated on your invoice and/or booking form. Failure to do so may result in cancellation without refund.

     

  • Prices are subject to change due to currency fluctuations, park fees, government levies, or third-party supplier increases.

     

3. Client Responsibilities

  • Travel insurance: It is the client’s sole responsibility to obtain comprehensive travel insurance covering medical expenses, evacuation, cancellation, loss of property, injury, or death. Proof of insurance may be requested.

     

  • Health & fitness: Clients must ensure they are physically and mentally fit to travel. Any pre-existing medical condition must be disclosed before booking.

     

  • Travel documents: Passports, visas, vaccinations, and other required travel documents are the client’s responsibility.

     

  • Conduct: Clients are expected to respect local laws, customs, communities, wildlife, and fellow travelers.

     

4. Risks & Liability

  • Participation in safaris, retreats, hiking, and related activities involves inherent risks (wildlife encounters, terrain, weather, vehicle travel, illness, accidents, etc.). By booking, you acknowledge these risks and agree to participate at your own risk.

     

  • Sidai Trails, its staff, partners, suppliers, and affiliates shall not be held liable for:

     

    • Illness, injury, accident, loss, damage, or death.
    • Delays, cancellations, or changes due to weather, strikes, political unrest, natural disasters, or events beyond our control.
    • Loss of property, baggage, or personal belongings.
  • Clients expressly waive the right to sue Sidai Trails for any claim, demand, or cause of action arising from participation.

     

5. Changes & Cancellations

  • We reserve the right to make changes to itineraries, accommodation, or transport due to safety, weather, or unforeseen circumstances.
  • If cancellation is made by the client:
    • Deposits are non-refundable.
    • Partial refunds may be available depending on notice period and supplier policies.
    • If cancellation is made by us due to circumstances beyond our control, we will assist with rescheduling but are not liable for additional costs incurred.

6. Use of Our Services & Website

  • Content on our website is for informational purposes only. While we aim for accuracy, errors may occur.
  • We are not liable for third-party links, services, or content accessed through our site.

7. Intellectual Property

All content on this website (text, images, logo, designs) is the property of Sidai Trails unless otherwise stated and may not be used without prior written consent.

 

8. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Kenya (where services are delivered) and England & Wales (for online business registration and contracts). Any disputes shall be subject to the exclusive jurisdiction of the relevant courts.

 

9. Acceptance of Terms

By booking with Sidai Trails, you confirm that you have read, understood, and agree to these Terms & Conditions, including the acknowledgment of risks and waiver of liability.
